1) Does it lock or can it lock?
2) Does the blade fold back into the handle?
3) How long is the blade (all of it including the curve?)

Theres the legislation! Honestly it depends on why you have it, where you have it and what you are doing with it when stopped! It could be a totally legal knife but if you have it open in your hand in the middle of a crowd for no reason you are going to have a bad day.
A big thing to remember in regards to if you do find yourself arrested under this legislation, its not for the Police to prove you are doing something wrong, the burden of proof lies with you to prove you are doing something right! Be careful!

You are right in that waving it around a nightclub will still probably get you locked up but under different legislation.

Can it be locked in the open position? Yes. Therefore it is a locking knife.
Take the barrel knife (it's essentially a friction folder that can fit inside a "barrel" that then makes it a locking folder)
